Judge Nazlan fixed up Najib on fabricated charges and a sham trial


In short, this is no longer just about Nazlan Ghazali’s alleged conflict of interest. It is about Nazlan committing a criminal act by sitting to hear a trial in which he knows the charges are totally flawed, defective, and incorrect. In other words, Nazlan is fixing Najib up on fabricated charges and a sham trial.

In 2015, the MACC was asked to investigate allegations of irregularities in SRC International. The MACC did a thorough investigation and concluded that prime minister Dato’ Sri Najib Tun Razak had not committed any wrongdoing.

In January 2016, attorney-general Tan Sri Mohamed Apandi Ali held a press conference to clear Najib of any wrongdoing. Apandi also showed the press a money trail flow chart to prove it.

If you scrutinise the money trail flow chart (above), this is the story that it tells.

On 11th December 2014, Najib received RM140 million through Fre Commodity Murabahah Term Financing-i (CMTF-i) obtained by Putra Perdana Development Sdn Bhd from Maybank Islamic Berhad.

On 12th December 2014, a transfer was made to Putra Perdana Construction Sdn Bhd. This was subsequently transferred to SRC’s bank account.

For the period between 8th July 2014 to 8th August 2014, there are three money transfers and withdrawal transactions from SRC’s current account (Amlslamic Bank Berhad, Jalan Raja Chulan, Kuala Lumpur, Account No: 211-202-201065-0) to Putra Perdana Construction Sdn Bhd (Maybank Account No: 014011327183) amounting to RM170 million.

On 14th July 2014, RM105 million was transferred to Putra Perdana Development Sdn Bhd, and on 11th August 2014, another RM30 million was transferred, making it a total of RM135 million.

On 8th July 2014, a transfer of RM34.99 million was made to Permai Binaraya Sdn Bhd.

On 14th July and 11th August 2014, Putra Perdana Development Sdn Bhd transferred the entire RM140 million it received from Putra Perdana Construction Sdn Bhd (RM135 million) and Putra Perdana Development Sdn Bhd (RM5 million) to the bank account of DLA Piper LLP (U) IOLA [DLA] at Citibank, New York, USA via two Telegraphic Transfer (TT) instructions.

On 8th July 2014, Permai Binaraya Sdn Bhd transferred part of the money received from SRC amounting to RM27 million into the account of Dato’ Sri Mohd Najib at Amislamic Bank Berhad, Jalan Raja Chulan, Kuala Lumpur, namely the Amprivate Banking-1MY account number 211-202- 201188-0.

On 12th December 2014, a total of RM140 million was returned to SRC by Putra Perdana Development Sdn Bhd through a ‘one lump-sum’ transfer after Putra Perdana Construction Sdn Bhd received a transfer of RM140 million from Putra Perdana Development Sdn Bhd on the same day. This was the RM140 million received from Fre Commodity Murabahah Term Financing-i (CMTF-i) obtained by Putra Perdana Development Sdn Bhd from Maybank Islamic Berhad on 11th December 2014.

After receiving the RM140 million on 12th December 2014 from Putra Perdana Construction, on 15th December 2015, SRC transferred a total of RM20 million directly to Ihsan Perdana Sdn Bhd (IPSB).

Between 9th December 2014 and 9th April 2015, SRC transferred funds to IPSB indirectly through GMSB via seven transactions involving a total amount of RM122.7 million. The transactions to GMSB are as follows:

I. 15th December 2014 – RM20 million
II. 9th January 2015 – RM39.7 million
III. 24th January 2015 – RM40 million
IV. 5th February 2015 – RM5 million
V. 6th February 2015 – RM5 million
VI. 13th February 2015 – RM13 million
VII. 9th April 2015 – RM3 million

On 26th December 2014, IPSB transferred RM5 million into Najib’s bank account no: 211-202- 201190-6, and RM27 million into Najib’s bank account no: 211-202-201188-0.

On 10th February 2015, IPSB also transferred a further RM10 million into Najib’s bank account no: 211-202-201188- 0 and, on the same date, the entire amount was then transferred to account no: 211-202-201190-6.

From this analysis and investigation of the money flow and money trail, it is very clear that the source of the money received by Dato’ Sri Mohd Najib Tun Razak is actually the result of financing from Fre Commodity Murabahah Term Financing-i (CMTF-i) amounting to a total of RM140 million received by Putra Perdana Development Sdn Bhd from Maybank Islamic Berhad and NOT from KWAP borrowings! Based upon the money flow and money trail, the money from KWAP is fully and totally used up by Putra Perdana Development Sdn Bhd.

Therefore, we can categorically and clearly declare that the charges framed against Dato Sri Mohd Najib Tun Razak that he received money from KWAP is totally flawed, defective, and incorrect. Najib actually received money from the Maybank loan. And at that material time Justice Mohd Nazlan bin Mohd Ghazali was the General Counsel & Company Secretary of Maybank and was involved in this loan transaction.

Furthermore, all investment decisions by SRC need to go through the 1MDB Board of Directors. Hence 1MDB had control of and had a say in what happened in SRC. Hence, also, the charges against Najib need to be withdrawn as it is totally flawed, defective, and incorrect. And the judge, Nazlan Ghazali, knows this very well and is hiding this fact.
