CEC reelection: Tan Seng Giaw must die


Kit Siang was so obsessed with killing Tan Seng Giaw that he overlooked the party constitution when he manipulated the 15th December 2012 party election and ended up killing DAP as well. Then he made it worse in the 29th September 2013 party reelection by increasing the number of branches by another 120 while the 2,576 delegates remained the same. What they did was so stupid it is unbelievable and DAP is now suffering the side effects of its fraudulent party elections.

DAP: THE INSIDE STORY

As they say, the devil is in the details. And this appears to be what tripped up Vincent Wu Him Ven and Anthony Loke Siew Fook when they rigged DAP’s 15th December 2012 party election or the 16th Party Congress. They overlooked some very crucial details and violated their own party constitution.

In the 15th December 2012 party election, 2,576 delegates from 865 branches attended. However, about 1,300 delegates did not receive their notice to the meeting, which means they were not allowed to attend the meeting. Further to that, 547 delegates who were not eligible to attend the meeting did, which means they were illegal delegates.

The voting was then held with the presence of the 547 illegal delegates and the absence of 1,300 eligible delegates now barred from voting. After a more than three-hour delay the results were announced and at 8.30pm the 20 winners to the CEC held their first CEC meeting to elect the party’s office bearers. The purebred Chinese Zairil was added in two weeks later to give DAP a Malay face

Two weeks later, due to a lot of pressure, DAP announced they had made a mistake. Vincent Wu was not one of the 20 winners after all. Zairil Khir Johari was. So Vincent Wu was replaced with Zairil. The truth is they suddenly realised they had no Malay face so they dropped Vincent Wu and replaced him with Zairil to give DAP at least one Malay face — although Zairil’s father and mother were both Chinese and not Malay and his real name is not Zairil Khir Johari.

In short, DAP pulled off the biggest fraud in Malaysian political history.

But then the ‘original’ CEC had already met two weeks earlier and had appointed the party’s office bearers. So, since that first CEC was wrong, and since the second CEC is the correct one, all decisions made by the first CEC are null and void and DAP should now hold a second CEC meeting — this time with the correct CEC members (meaning without Vincent Wu and replaced with Zairil).

But they did not. They accepted the decisions of this first incorrect or illegal CEC meeting without holding a second CEC meeting comprising of the correct CEC members.

A complaint was then lodged with the Registrar of Societies (RoS) and DAP was instructed to hold a second party election. This was actually not a different party election but a reelection. In other words, DAP needed to redo the 15th December 2012 party election. So it would still be the 16th Party Congress and not the 17th Party Congress.

On 29th September 2013, DAP held its party reelection. Dr Ong Kian Ming then announced that 2,576 delegates from 985 branches had attended the meeting. The branches had increased by 120 but the number of delegates remained the same. And this was the first mistake they made. How can the branches increase by another 120 when the CEC was illegal and, hence, was not authorised to approve new branches?

Secondly, the reelection should have been based on the attendance of the 1,300 delegates that were barred from the 12th December 2012 meeting and minus the 547 illegal delegates. This means 2,576, minus 547 and plus 1,300 or roughly more than 3,300 delegates (and, of course, minus the delegates from the ‘new’ 120 branches that have not yet been legally approved).

The problem with this, though, is that if they barred the 547 illegal delegates from attending the reelection on 29th September 2013 and instead allowed the barred 1,300 delegates to vote, Tan Seng Giaw is going to win the top slot while Kit Siang will be in the bottom ten and Guan Eng might not even be in the list of 20 winners. So they could not correct the 15th December 2012 transgression as the RoS had instructed DAP to do.

In short, in the 29th September 2013 reelection of the 16th Party Congress, DAP repeated the error or discrepancy of the 15th December 2012 party election. And, to make it worse, they made more errors by increasing the number of branches by 120 (which were not approved) and yet the 2,576 delegates mysteriously remained the same.

So, instead of putting out the fire, they poured more oil onto the fire and made it worse. And the 29th September 2013 party reelection burned DAP in the event the 15th December 2012 party election did not burn DAP enough.

Kit Siang knew they could not allow those 1,300 delegates barred from the 15th December 2012 meeting to attend the 29th September 2013 meeting. And, on top of that, if they barred the 547 illegal delegates from attending the meeting as well, that would be the end of his political dynasty. Instead, Tan Seng Giaw, Teng Chang Khim, Nga Kor Ming, Ngeh Koo Ham, Chow Kon Yeow and Boo Cheng Hau would be the top ten winners while Kit Siang, Guan Eng, and the the rest of his team would be in the bottom ten or not even in the list of 20 winners.

So, the 15th December 2012 party election was rigged and then the 29th September 2013 reelection was rigged even more. And a second complaint was lodged with the RoS but DAP just ignored the instructions of the RoS to hold a re-reelection (or third election). If they did they would first of all be admitting that the 15th December 2012 party election and the 29th September 2013 party reelection were fraudulent. Secondly, if they were to follow the correct delegates list (meaning 2,576 delegates minus 547 illegal delegates and plus the 1,300 barred delegates) then Tan Seng Giaw is in and Kit Siang and Guan Eng are dead meat.

The RoS till today has not accepted and recognised DAP’s 15th December 2012 party election and the 29th September 2013 party reelection. DAP has to rectify this with a party re-reelection, which they have not. That means DAP is an illegal organisation and can get deregistered any time. The knife is now in the hands of the RoS and that knife is currently at DAP’s throat. And DAP’s stupidity and arrogance is what caused this.
