Unable to serve subpoena on Anwar’s ex-speech writer


The defence in the ongoing trial of the civil action over a RM445-million syndicated loan facility tells the court that it failed to serve the subpoena on Mohd Faiz Abdullah. 

(Bernama) – The defence in the ongoing trial of the civil action over a RM445-million syndicated loan facility told the High Court here today that it failed to serve a subpoena on Anwar Ibrahim’s former speech writer.

Counsel D Paramalingam, acting for businessman Low Thiam Hoe, who is the defendant in the case, said three attempts to serve the subpoena on Mohd Faiz Abdullah at his house here, were unsuccessful.

Mohd Faiz was to be subpoenaed to testify as the defendant’s witness in the trial.

Paramalingam said the defence had no more witness to testify and with that, closed its case.

Judge Hadhariah Syed Ismail fixed May 24 to decide on the suit and ordered both parties to file submissions by May 3.

Anwar had also been subpoenaed to testify in the suit as well as Hong Leong Bank Berhad chairman Quek Leng Chan. However, they succeeded in their application to set aside the subpoenas.

During the trial, the High Court was told by Low that sometime in March 1997, two individuals, Hamzah Harun and Mohd Faiz Abdullah, from a company, Arus Murni Sdn Bhd, had told him they were principals acting on behalf of Anwar and Quek.

In 1998, Hong Leong Finance Berhad (HLFB) filed the suit against Low for failure to repay a RM28 million loan to the bank.

The following year, Low filed a counter-claim against HLFB, HLG Capital Markets Sdn Bhd and Seow Lun Hoo, who was Hong Leong Credit Berhad’s former chief executive officer, seeking general damages for wrongful and negligent advice.
