DAP: Zambry and exco still barred from assembly

(The Star) – Perak Pakatan Rakyat is adamant that Perak Mentri Besar Datuk Seri Dr Zambry Abd Kadir and his six executive council members should still be barred from attending the state assembly sitting tomorrow.

Perak DAP chairman Datuk Ngeh Koo Ham said the Federal Court had erred in its judgment on April 16 when it allowed two declarations stating that the State Assembly Speaker V. Sivakumar’s decision to suspend Dr Zambry and his executive council members from the state assembly, as null and void.

In a statement, Ngeh said the decision by the Perak Committee of Special Privileges to suspend them “still stands.”

“It was not the Speaker’s decision to suspend Dr Zambry and the exco members but the committee’s,” he said.

He said the case should have not been brought against the Speaker because he was granted immunity under Section 3 of the Legislative Assembly (Privileges) Enactment 1959.

“Furthermore, the court’s decision was only a declaration and it was not certiorari (to quash the order),” he added.
