Apex court junks AG’s PAA appeal against Nik Nazmi’s acquittal

(MMO) – This decision is now set to influence all other cases involving the same offence that was used against Nik Nazmi, which had previously been postponed and put on hold.

The Federal Court has struck off the Attorney-General’s (AG) bid to appeal against PKR lawmaker Nik Nazmi Nik Ahmad’s acquittal by the Court of Appeal on April 25 last year, lawyer Latheefa Koya said today.

According to Latheefa, deputy public prosecutor Manoj Kurup has withdrawn the application to challenge the landmark decision that it was unconstitutional to criminalise spontaneous public assemblies in breach of the 10-day notice required under Section 9 (1) of the Peaceful Assembly Act (PAA) 2012.

“[The application was withdrawn] on the principle that the matter started at a sessions court. So final [avenue was] at the Court of Appeal,” Latheefa told Malay Mail Online when contacted.

Besides Latheefa, the PKR Youth chief was also represented by lawyer N. Surendran in front of five-man Federal Court bench led by Justice Tan Sri Md Raus Sharif.

This decision is now set to influence all other cases involving the same offence that was used against Nik Nazmi, which had previously been postponed and put on hold pending the outcome of the Attorney-General’s Chambers (AGC)’s appeal at the Federal Court today.
