(Malaysian Mirror) - The Federal Court will hand down its ruling on the MB vs MB case on Feb 9.

Nizar's lawyers confirmed that the decision on the ousted Perak MB's application has been set for Feb 9.

The decision will put an end to the ongoing tussle as to who is the rightful MB of Perak .

A five-man Federal Court bench heard the Nizar vs Zambry Abdul Kadir case in November last year, immediately after rejecting Nizar's request for a full panel to hear the case.

The Federal Court judges are Alauddin Sheriff, Arifin Zakaria, Zulkefli Makinudin, Ghazali Yusoff and Hamid Embong.

What Nizar wants

Nizar, among others, is seeking a declaration that he is the rightful Perak menteri besar.

He is also seeking an interpretation of Article 16(6) of the Perak constitution on whether the menteri besar's post can be vacated when:

• The menteri besar had advised the ruler on dissolution of the state legislative assembly;

• There was no dissolution of the assembly;

• There was no motion of confidence against the menteri besar in the state legislative assembly; and

• The menteri besar did not resign.

In his application, Nizar said Zambry should cite the authority that allowed him to legitimately become the menteri besar.

Nizar is also seeking a declaration that Zambry has no right to be menteri besar at any material time, plus an injunction to prevent him or his agents from continuing his task and role as the menteri besar.

What verdict??

The whole show is a joke, a very sick joke.

The judges have to take care of their own backside, otherwise their careers with be gone, to cold storage.

The biggest judge the silverstate royalty is down with dementia, so he is not going to say anything, after all his action spoke larger than words. The winner was Gamuda, as every other sucker knows.

Sad to be a perakian, but its all shit now.

And sad enough, the people of Perak will forget, becos' the UMNO bastards will dangle the carrot, and short term gains will matter most, looking at how the NS people voted for the super B, Isa for giving out rice cookers, and muruku flour.

I wish Nizar the best, I have lots of respect for you, not only as a nice and sincere human being, but also a professional politician.

Even if the court rules that the mamak is the mb, so what ? He will be an mb only in name , without any state to administer , Perakians will not recognize him as their mb.

Looks like Nizar would need to wait until the next GE to have any realistic chance of becoming the MB again for Perak. It's in the voters' hands, not the Federal Court.

I am not waiting with baited breath to learn what the ruling will be. The only way we can get a ruling which is not a twisted version of whats clearly in the constitution, is when APCO Worldwide advises the govt that it (the govt) had better muscle the Fed Court to rule in favour of Nizar just to gain some brownie points. But if that happens then UMNO would look stupid as well for having tried a power grab without due process being followed.

Either way, UMNO-BN is screwed. Is that good? Yes it is! smilies/grin.gif

if their stick to the constitution and the law, the ruling should be clear...there is only one MB and it is Nizar. The other is MB Haram. simple actually, even ordinary people know that the power to sack any MB can only be done in the state assembly. But our judges, well they know it too....well lets wait and see.
