Inquiry results not to be questioned: Malaysian PM

KANGAR - Conclusions made by the Malaysian Royal Commission of Inquiry (RCI) into opposition aide Teoh Beng Hock's death should not be questioned as this will only defeat its purpose, said Malaysian Prime Minister Datuk Seri Najib Tun Razak.

He said the RCI was an independent body, which had been set up with the Yang Di-Pertuan Agong's consent and made up of individuals with high credibility to investigate the matter openly.

“What is the purpose of setting up the RCI if its findings are questioned? There are groups which questioned it because they are unhappy with the findings.”

“They have made their own conclusion and they wanted the RCI's report to reflect their thinking and demands. That is unfair.”

“The truth remains the truth whether it is bitter or easy for us to accept. We can't deny the truth,” he said after meeting the Perlis Barisan Nasional leaders yesterday.

The Commission had concluded that Teoh was driven to commit suicide due to intensive interrogation by Malaysian Anti-Corruption Commission (MACC) officers. -- THE STAR/ANN

Prime Minister Najib Tun Razak has a point here. The problem is when he said “…should not be questioned…”.

Anything can be questioned. To say “…should not be questioned…” is just like England of 500 years ago. When you questioned the church or the King you would be arrested, tied to a stake, and burned alive. Surely we have come a long way since then from the days when everything “…should not be questioned…”?

Nevertheless, what Najib said was true on the other part of his statement. If the RCI had come out with a verdict that we like we would have applauded its findings. We would have praised the RCI to kingdom come.

When the Shah Alam High Court allowed my habeas corpus and ordered my release from detention in November 2008, the judge was one fantastic guy. If he had rejected my application and ruled that I should remain in Kamunting, then the judge is an arsehole who is corrupted and is in Umno’s pocket.

That is how we think.

Okay, we demand a RCI on the Ahmad Sarbaini Mohamed death. Say the government does hold the RCI as what we want. And say the RCI comes out with a verdict that he died while trying to escape through the third floor window. Would we be satisfied or would we be up in arms? Say, instead, the RCI comes out with a verdict that he was killed while under interrogation. Would that satisfy us and would we praise the RCI to high heavens?

Actually, we have already decided how Teoh Beng Hock, Kugan, Ahmad Sarbaini, and many more died. Sure we want a RCI to be held. But we want the RCI to come out with a verdict that dovetails with what we have already decided had happened. And if the RCI contradicts what we believe, then we are going to raise hell.

This makes it very difficult, of course. What we want is not a RCI to determine the truth, whatever that may be. What we want is a RCI to confirm what we believe.

If we already believe what happened then why not we just go on and believe this? Why bother to ask for a RCI to be held when we know the RCI is going to rule against what we believe?

The chances of the RCI coming out with a verdict the same as what we believe is very slim. The chances of the RCI coming out with a verdict that we don’t believe is very likely.

So why bother?

Many believe Anwar is innocent of the allegations of sodomy and the porn tape and what have you. If that is what we believe then let it be. Let’s not bother with an inquiry or investigation or whatever because the chances would be the findings or verdict will not be what we want.

Let me put it this way: if you already believe that there is a God in Heaven and that when we die we would go to either Heaven or Hell and Muhammad or Jesus or whoever is our Prophet and there is no changing our mind on this matter, does it serve any purpose talking about this matter?

If I tell you I believe what you believe, you will be extremely happy. And if I tell you that you are talking crap and what you believe is a myth, you will be terribly unhappy. 

In short, you do not wish to discuss or debate this issue. You want me to agree with you and not contradict you. Better we just avoid the issue and not talk about it then.

To me it's simple. TBH was in custody of MACC. IF i commit suicide while under MACC then MACC is at fault, they should prevent my death. Or, IF i was dangled out the window and slipped out of MACC officer grip, then MACC still at fault, they should not cause my death. The difference is like: leaving my car engine running with a child inside the car, Or driving into a pedestrian. Either way, the MACC is a fatally dangerous place to be. And (here it is) MACC is at fault for the death of TBH.

Yeah lah! Our PM is right.

But (I love this wonderful word - but), I recall that lawyer fella, Lingam who cavorted and holidayed with the judges etc, he was not too happy with the RCI's conclusion about his relationship and influence with the judges. He is challenging the RCI's findings in the court.

So whats wrong if some of us are challenging or querying or doubtful about the RCI findings on TBH's death?

All of us, whether for or against are entitled to our biased opinions about such matters, especially after having being lied to by politicians from BN for 50 years (and recently Pakatan politicians also seemed to have a penchant to tell half truths, no outright lies yet until they come into power eh?)

Something to add. Till today, for example, no one knows who gave the orders to release the controlled explosives called C4. And till today, they can't establish any motive for the murder. How about setting up some kind of commission to investigate on the murder of Altantuya? No need to be a Royal one with King's consent and all that jazz, what a waste of time. Just a commission with it's members comprise of highly respected figures from the various commonwealth countries? Umno can pick half of the members in the panel and opposition the other half.

If he dares to do that, I'll say he has a point and polish his boots for him by licking!

The other consideration is - what other alternatives are available to the family of Sarbani? Even TBH's family asked for the RCI report to be released even though they withdrew from the RCI.

In Malaysia, justice is not only blind-folded, it is bound hand and foot and ISA/EO shoved down its throat.

The above statement is the whole crux of the matter. What the RCI really independent? If it is not, the all its procedures and decision should be question - not just questioned but thoroughly - gone over with a fine tooth comb, every sordid detail dug up etc.

Only in this way can progress and the people's rights be protected. Only in this way can the Third Force be given it rightful place in govenrment of Malaysia.

Many evidences point to the fact that it is very unlikely that TBH killed himself. The glaring fact is that he died! Who did it? From what transpired, we are very skeptical about the professionalism of the inquiry process. We saw how MACC official, in various incidences tried to hide the truth. Many suspicious actions during that day were highly questionable. Why didn't RCI pursue the intention behind those actions, is beyond my comprehension. Dr Pontip's conclusion was brushed aside. But the point Najib made is based on the existence of 'A Truth'. Now what is this Truth? If the truth was found through a process that was just and seemed just then an outcome so deduced on that truth could be accepted by the rakyat. The real point is that the process that lead to declaring this truth, itself was flawed and therefore the "truth" that Najib says that we have to accept is no more true. The subsequently outcome from the declared "truth" is misleading and does not justify the crime. That is why the Bar Council said that full responsibility for Teoh Beng Hock’s death lies squarely and solely on the MACC and as such, the officers named in the report should be punished immediately for committing offences under sections 304 and 304A of the Penal Code, namely for culpable homicide not amounting to murder and for causing Teoh’s death by negligence.
So TBH, Kugan and Sarbaini 's death is all about a flawed process by the incompetent and conniving government agencies. These are the very people who have been entrusted to do the rightful but instead collude with the powers of the day to present false evidence. So how can the people be happy with the verdict when the very "truth" that Najib wants us to accept is not the truth.

I beg to differ a little from RPK although in general, it has its truth.

In concluding its findings, whether the pill be bitter or sweet, the RCI's report must be intelligent, more specifically, intelligible.

What we are see in the media, is the ultimatum, meaning the Conclusion. What we don't really see, is how they specifically arrived to the conclusion, in terms of the multiple basis beyond reasonble doubt, that leads to each member's idea of why it should conclude that way.

This simply means that each expert must give their 'expert opinion' in their own words, and all of their opinions must be fathomable, justified, clear, logical, legal and conclusive, and then unamimously in tandem to form the ultimate conclusion. And their individual opinions along with theri names must be quoted clearly, to maintain accountability, which means if an 'expert' quotes a statement/finding that is ambiguous or inconclusive in some manner, but still is able to conclude in tandem with the rest, then this 'expert's' credibility and/or authority is in question.

If ever his credibility of logic, law or otherwise is in question, then he is not fit to be part of the panel of such esteem, honour and responsibility.

Did I confuse anyone? Hope not.

In short, I WILL swallow the pill, bitter or sweet, IF, and only IF the RCI can convince me how and why they have arrived at such a conclusion. Simply telling me the just a YES or a NO is NOT good enough for me. CONVINCE ME!

No, he has no point. Not when the whole circus was not conducted in a transparent and fair manner. I remember in not many years ago when cases of great importance happened, it usually involved highly respected figures from other commonwealth countries to make judgement. Justice must be seen to be done in the public eyes. It's no so when expert witness were bar from testifying in the beginning and not when the final report were deliberately delayed.

The RCI had concluded their findings. And yet some who ask for the RCI are not happy? So, what is the problem here? The problems could be:-
1) The people who ask for the RCI wants to hear the verdict already in their minds.
2) The RCI is flawed . Had made a mistake.
3) The RCI is bias to please the hidden hands behind.
4) The RCI is unnecessary ( in Malaysia ) . A waste of public fund.
So, whatever had happened already happened and since the RCI is final. What is the next course of action?. Sue the MACC and government for negligent or causing the death of Teoh through criminal force? The best would still be to sue first and then vote out Barisan Nasional come next election.

There is not much difference between the Malaysian judiciary and the RCI. Both are appointed by Najib thru Agong. So the independence of both is suspect. The composition of the TBH RCI was rejected even by the TBH family at the early stage. So if Najib wants us to believe the RCI then he should not interfere in their appointment and independence

Will Najib dare appointment an RCI with 60% of it's members from the opposition. Will Najib then accept the verdict of such an RCI ? So it is only to be expected that Malaysians will reject any findings of an RCI if the RCI itself is suspect.

Malaysians still hope within their hope that one day the RCI can be independent.

In the TBH case, a sitting judge of the Fed court was appointed to lead it. That destroyed any pretence Najib made of an "independent" judge to lead a crucial RCI.

Do remember too that the findings and recommendations of the 2 previous RCI's have not been acted upon by Najib. They are "still looking for certain witnesses' in the LIngam matter and that of the CJ who went on holiday with Lingam and Vincent Tan. This despite testimony in open hearing by witnesses of the respective culpabilities of Lingam and the CJ. UMNO/BN have repeatedly insulted our Agung with impunity!

So, right from the beginning the TBH RCI was a whitewash to find no one directly guilty who could be charged with Murder1 so that the guilty parties can be "kow thim" elsewhere.

Sounds familiar?

And the seeds of another whitewash coroner's inquiry is being sown with that scurillous Shafee's manipulation that Sarbaini's untimely and mysterious death was not murder.

The root of the problem is Najib as head of UMNO. Due to his greed, he sought ways and means of getting back Selangor. Of course, the DOGS had to do their level best without conscience to please Najib which caused Teoh's death. In this regard, what is the use of establishing RCI? It is a waste of money. We have already known what would come out of RCI. If we do not seem to see justice done, of course, people have the rights to question. Government is wasting tax payers' money and therefore, we should question the finding.

In the RCI for Lingam, he himself with the former CJ and another party disputed certain findings and pressed for a judicial review.

Since when is this country's RCI telling the truth? All this while RCIs are being used to get lapdog agencies, and murderers off the hook. Same thing also with "inquest", nothing more than a "dog and pony show" to cover guilty regime's agents arses. So much so, now I have regarded the RCI and Inquest to be similar to "lawak bodoh Scenario" in TV3. Meaning, the outcome is so predictable you don't have to bother following the proceedings to know what the outcome is going to be.

(I am not talking about court cases here, I am talking about RCI and Inquest).
