KUALA LUMPUR: Malaysia Today editor Raja Petra Kamarudin is being investigated under Section 233 of the Communications and Multimedia Act 1998 for an article he wrote recently titled Let's send the Altantuya murderers to hell.

It is learnt that eight police officers from the Federal Commercial Crimes Investigations Department (CCID) visited Raja Petra’s house in Sungai Buloh here at about 9am on Friday.

They seized a laptop and a CPU (central processing unit) before leaving at about 11am.

According to Raja Petra’s wife Marina Lee Abdullah, her husband had also been served with a notice requesting him to present himself at the CCID office in Bukit Perdana on Friday evening.

It is learnt police officers from the cyber crimes investigations unit are expected to record his statement over the article he wrote and posted on the Malaysia Today online news portal on April 25.

CCID director Commissioner Datuk Koh Hong Sun confirmed his officers had visited Raja Petra to assist police in their investigations.

He declined to elaborate further.

It is learnt that the CCID officers would be investigating certain allegations made in the article that were deemed false and defamatory.

Under Section 233 of the Act:

1) A person who

a) by means of any network facilities or network service or applications service knowingly —

(i) makes, creates or solicits; and

(ii) initiates the transmission of,

any comment, request, suggestion or other communication which is obscene, indecent, false, menacing or offensive in character with intent to annoy, abuse, threaten or harass another person; or

b) initiates a communication using any applications service, whether continuously, repeatedly or otherwise, during which communication may or may not ensue, with or without disclosing his identity and with intent to annoy, abuse, threaten or harass any person at any number or electronic address,

commits an offence.

2) A person who knowingly

(a) by means of a network service or applications service provides any obscene communication for commercial purposes to any person; or

(b) permits a network service or applications service under the person 's control to be used for an activity described in paragraph (a),

commits an offence.

(3) A person who commits an offence under this section shall, on conviction,be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding one year or to both and shall also be liable to a further fine of one thousand ringgit for every day during which the offence is continued after conviction

To me RPK can be charged under Section 233 no question about. I hope the person/s press charges against RPK. If he/she doesn’t then they have something to hide. If they do they may or may not win but the collateral damages will be devastating.

Another interesting point on how widely the court will apply the conviction under the Multimedia Act have to be balanced out with the safeguards to the accused's rights. In countries which have Bill of Rights, Human Rights Act or are party to some Human Rights treaty, any conviction have to take account of the rights of the accused. Every country has laws which are rather similar with the Multimedia Act but to convict those countries which have laws and convention to safeguard human rights, the courts have to balance out the law and the person's rights. This is why Bill of Rights or Human Rights Act are important. If Malaysia follows somthing similar with the European Convention of Human Rights, the detention under ISA breaches the ECHR on right to a fair trial. Even slander and libel laws have to comply with human rights.

It would come down to proving intention to make a conviction. So, it's how widely the court would interpret intention. This is because you can practically charge any person for the above act and you will find many bloggers including from BN committing the act per se (TDM is one similar example).

Here's a quick 101 on criminal law. Almost all crimes have 2 components, the act (actus reus) and intent (mens rea). The act is whatever the wrongful act is, for example the act above it's transmitting obscene, offensive, indecent, false, menacing publication. Then the second part is the intent. In this case the intention is intent to annoy, abuse, threaten or harass another person. Thus to get a conviction under section 233(1)(a), both components need to be fulfilled. You have to apply the specific act and intent for convictions under other sections of the act, so conviction under section 233(2) would require different act and intent than 233(1)(a). Just read the words carefully and you can get a rough idea how it works.

The act component is very wide and most bloggers from TDM to RPK fulfils it. The intent part is contentious and we do not know how widely the court will view it.

Another example of the relationship between act and intent is in a charge of murder versus manslaughter. Murder is basically killing with intent and manslaughter is killing without intent. So, a person who innocently throws a rock over the cliff without prior knowledge of anyone below and kills the person below, he commits the act but no intent to kill as his intent was to randomly throw a rock over the cliff, thus a manslaughter conviction rather than murder. Whereas a person who knows that people often walk beneath the cliff and intents to hurt people, and accidentally kills someone, he can be convicted for murder as the intent for murder is not just intention to kill but also include intention to cause harm to others.

It will be interesting if this gets to court.

The police told me that if I made it easy for people to commit a crime, means I do not have the right to action as I encourage the perpetrator to commit crime. OK, looks like subsection (2) is out, as I don't think there is 'commercial purposes' involved. Subsection (1) seems to be the area of interest here. Maybe the legal eagles can explain further.

But, from an ordinary Joe's point of view, there is nothing Petra wrote that is harmful unless someone feels the spiciness of the chilli padi. And he has already stated that opinions are like s-wholes - everyone has one, from the mamak stalls to the top of the ivory towers, EVERYONE has one. And I am sure Selev Shaaribuu has a strong one too. I think the least the police can do is to inform the rakyat under whose report this action was taken against RPK.

The Altatuniya trial must be conclusive and all allegations investigated first before the CCID can prefer any charges against RPK.

I just don't see how the CCID can charge RPK under those listed acts, if they can then they ought also to charge all those behind posts by NST, Star, Utusan that are in the same vein or worst. I skipped that article when RPK published it. I really get bored with the whole issue, where we know where justice lies.

But after this news broke out. I revisited the article. I don't find anything seditious. So, where is the catch line?

Reading through the sect 233 attached here, I am afraid there are in that case many blog articles that contravene the act. Why only RPK then? In fact, RPK can make charges against some blogs that are offensive towards him too.

My take is, sue RPK for a few hundreds of millions for those who know they are clean. Why don't they?

RPK is really a master of strategies. By writing a provoking article and baits his opponent to take action against him is just a pure publicity stunt to ensure it will gain wider publicity. It is obvious who is behind this police attack on RPK - Najis of course, and his Rots-MaHai. After finding out that they can't get RPK with the Seditions Act, they are now trying to find all sorts of statutes to try and throw the book at RPK to either put him away or shut him up through intimidation.
