Don't Destroy The Judiciary, Says Tun Salleh PDF Print E-mail

(Bernama) -- "If you destroy the judiciary, you destroy democracy and if you destroy democracy, you are assured of dictatorship" -- this is the strong message by former Lord President Tun Salleh Abas in relating his sacking from the judiciary in 1988.

Tun Salleh, 79, expressed the hope that the 1988 judicial crisis would serve as a reminder to the present and future generations on the need to have a strong and independent judiciary.

"I also hoped the 1988 judicial crisis will come to an end and remain forever in the Malaysian legal history," he said after receiving an ex-gratia payment from Minister in the Prime Minister's Department Datuk Zaid Ibrahim at his residence here Friday.

With Friday's payment, the government had presented the goodwill ex-gratia payments to all six judges who were either sacked or suspended from duties during the crisis.

Apart from Tun Salleh, those sacked were Supreme Court Judges Datuk Seri George Seah and Tan Sri Wan Hamzah Mohamed Salleh.

The three who were suspended for three months were Supreme Court Judges Tan Sri Azmi Kamaruddin, Tan Sri Eusoffe Abdoolcader and Tan Sri Wan Suleiman Pawanteh.

Tun Salleh also expressed his gratitude to the current leadership for the gesture extended to the six former judges.

"I would like to express my thanks to the new government and Zaid who tried to bring an end to the shameful episode. I know that it is very difficult for the government to give a complete apology in the present political senario," he said.

Tun Salleh said the ex-gratia payment and the acknowledgement of what the judges' had gone through during the crisis, was a form of compromise on the part of the government.

At the same time it was also an important step towards the restoration of the judiciary to its golden era, he said.

"There is no need to elaborate but I think it is within the public's perception and knowledge," he said.

He also hoped that the incident would never recur in the future.

Meanwhile Zaid, the de facto Law Minister, said there was no need to reveal the ex-gratia amount as it was paid to honour Tun Salleh's services in the judiciary.

"He is the epitome of judges with principles, dignity and bravery in defending the principles. He is the symbol to be proud of," said Zaid.

Judicary reform?

Well.. Altantuya's case will be the great test for judicary in M'sia. We wait & see lah... whether any cover-up this time.

The most effective way to RESRTICT DEMOCRACY is to transfer decision-making from the public arena to unaccountable institutions: kings and princes, priestly castes, military juntas, party dictatorships, or modern corporations.

The law, in its majestic equality,

A) forbids the rich as well as the poor to sleep under bridges
B) forbids to beg in the streets
C) and forbids to steal bread.

But tha Laws in M'sia allows the rich to steal bread (above C)

Tun Apanama really screwed up the whole country. Unless and until the Constitution is returned to its pre-1981 version, all these so-called reforms are merely superficial. This is a good start, but if it ends here, we're back to nothing.

The Judiciary would not have recovered from its humiliation and 'full' independence until they have done their basic jurisdiction and responsibility in trialing TUN for his gross disservice to the nation and Rakyat. It would be a good start to prove its independence to trial Tun to prove the point that crimes do pay.

This is tax payers money so why can't we know the amount paid. I agree with the payment but tell us how much. It is not Barisan's money.
In any case, what is there to destroy. The judiciary is already destroyed.

Tun Salleh, the right thinking Raayat hormat you !

As with all crimes or someone planning a crime, the perpetrator must must answer to the Raayat.

In this case, the Dictaor wannabee and his gangs of co-conspirators must be purnished for the Crime of the State in Judiciary destruction.

The time is now, before MM stop kicking. Mentally, must pay for his crime !

Dear Tun Salleh Abbas,

It was truly sad that there were not enough people came to your rescue, and many didn't understand the implication of sacking the highest ranking judge. The sacking, as we all could see now, has tilted the government power way too much to the executive branch so that we essentially render the judicial institution in disarray. I have read your story and found you had displayed your courage and did your best in defending the judicial institution, and I admire your courage, even though we as a nation failed to protect the judicial institution in its most challenged moment. For those of us of adult age in the fateful 1988 should repent for not exercise enough civil duty to protect our constitution - which has prescribed role to the judiciary branch of the government. Only through admitting our fault we could pick up the civil responsibility as the people in a democracy nation.

Tun Salleh, why not let the whole nation know how much you received since the de facto Law minister Zaid refused to reveal the quantum. Otherwise, that Zaid or his master could be declaring a different figure to the auditor general against what you actually received. You know what I mean?

The Judiciary may be 'impartial' or 'independent' BUT long as the AG is a political appointment by the PM, what 'cases' will there be if those in the corridor of power are not brought to court as the AG can just say, Not Enough Evidence or whatever. In the eyes of the public, the AG is perceived to be the most powerful man in the judiciary system. Only he alone has the final say if a case is brought to court or not. You can have all the Tun Sallehs in the court but no case(s) for trail ....... ??? (i rest my case)

Thanks for your brave services to the country. We hope many more Judges as brave as you will rise up and bring justice to our country. Even communist China has a justice system with higher integrity than us.

The amount of the ex-gratia payment to the 6 judges is not important. What is important is what former Lord President Tun Salleh Abas said

"If you destroy the judiciary, you destroy democracy and if you destroy democracy, you are assured of dictatorship"

Dignity is what former Lord President Tun Salleh Abas & 5 other judges wanted, not the money. Thank you for all your wisdom and sorry for your sufferings & sorrows you went thru' since 1988.

Time to reform AG's power as well. There should be a panel to review cases closed by AG should there be appeals that such cases be reviewed.

There is nothing left to be destroyed. What the govt doing is smoke screen. They have to do better in order to restore the confidence of the rakyat on the judiciary. Making payments for past mistakes is more of a political move.

If DoWi's BN govt is sincere in reforming the Judiciary then he must RESTORE article 121 of the Federal Constitution first before even thinking about Judicial Reformation.

We were greatly imppressed with your previous experience in the 'international trial' held in kuala lumpur of those involved in the Iraqi war

So may we now invite you to set up a special 'court' to look into the transgressions of all those cabinet ministers you appointed & reappointed for years & years & who you now accuse of corruption & sins of commission & ommission
I would suggest the following list

1. All those who have publicly attacked you
2. All those who are likely to attack you in future

Btw I wonder what revelations would appear
if Najib were to suddenly decide to attack you publicly...

it's always about money...sigh...
so our beloved tun salleh is now satisfied with the "apology".

the govn just chose the right time to give out millions (6 judges, can't be less that right?) while the rest of the rakyat is suffering from the price hike. wayang at this time will not divert us from your mistakes... stop acting ok...
