Former Lord President Tun Salleh Abas has dared his critics to call for a Royal Commission of Inquiry to investigate the 1988 judicial crisis instead of prolonging debates on the issue.

He said he wanted to forget the crisis and put everything behind him but there were people who were not happy with him getting the ex-gratia payment from the Government.

“If anybody is not happy with my innocence, call for the Government to set up a Royal Commission of Inquiry to investigate,” the 79-year-old Salleh said, when contacted.

He was reacting to discussions about why he and other judges who were dismissed in 1988 were given the ex-gratia payment when two separate tribunals had found them guilty of misconduct.

One particular article was by lawyer Matthias Chang, who served as political secretary to Tun Dr Mahathir Mohamad while he was the Prime Minister.

The article posted on bigdogdotcom.wordpress.com bore the title “Tun Salleh: Guilty or not guilty for judicial misconduct?”

Salleh said there were those who were happy that the payment had sort of cleared his name but some were still “so unhappy.”

“I think these unhappy people who doubted my innocence should channel all their energy to something more positive and that is to call for the Royal Commission of Inquiry.

“I never lobbied for the ex-gratia payment. All these years,I have been living in my kampung for 20 years.

“Suddenly the Government decided to resurrect me and address my innocence,” said Salleh, who was brought before a tribunal for misconduct in 1988.

Five judges of the Supreme Court granted him an interim order against the tribunal. The order was later set aside and in August 1988, Salleh was officially removed from the post of Lord President.

The five Supreme Court judges who granted Salleh the interlocutory order – Tan Sri Azmi Kamaruddin, Tan Sri Eusoffe Abdoolcader, Tan Sri Wan Hamzah Mohamed Salleh, Wan Suleiman Pawan Teh and Datuk George Seah – were suspended.

In October, Wan Sulaiman and Seah were sacked while the three others were reinstated.

Ahirudin Attan in his blog Rocky’s Bru (rockybru.blogspot.com) posted the news about Salleh’s challenge yesterday to Chang.

The blog also said the Royal Commission of Inquiry should call as witnesses, the main players in the 1988 event which included Dr Mahathir, the then Chief Secretary to the Government, the then Attorney-General Tan Sri Abu Talib Othman, Tun Hamid Omar, who chaired the 1988 Tribunal and who succeed Salleh after his sacking and the surviving judges who were suspended or sacked by the Tribunals.

Tun Salleh Abas, the present Government had made their offer. Whether that was a sincere effort or otherwise is a separate matter. But the mouthpiece of the former PM had come out openly to condemn and ridicule you again. Because he saw you as a threat to his credibility just as he's doing the same to the PM now. He wanted the Nation to feel he was God-sent to this world and a messenger of the greatness he thought he had. But many had already labelled him as no better than a 'gutter politician'. He stoop so low to demean his 'Tun' and challemge the Government with his seditious statements in and out of the country. Your call for a Royal Commission of Inquiry would not be entertained because the Government had settled the matter as far as it is concerned. He is desperate and shall have to face the ultimate judgment just like all of us. That shall be the defining moment. Not mortal justice. Let it be.

Dear Tun, The pension is not the "worth of the money" but the "worth of innocence" which no amount of money can buy. Keep the pension for as "it is the only proof of innocence" the Malaysian Government has given to all of you. Let those who curse meet their creators, as they do not have the guts to actually search for the truth. Have a long peaceful life & GOD bless your family.

Tun Salleh, very few people in this world today we can be look upon for holding such high integrity to justice. People assosiate with Mahathir such as Chang is worth to be ignored. This pariah has a snake's tongue master of manipulation.

In support of Tun, You deserved more than just [ex-gratia payment]. As the existing Gorman had made up their collective agreement, anyone who made any comment; Tun does not owe them any answer at all.
Twenty years without a true, honest and respectful judiciary this country’s morale has been tarnished during the regime of TDM and after those 20 years it is never too late for the Rakyat to correct the gormen. This is just a beginning and we are all fortunate being a Malaysian and we collectively show the gormen the way.

I agree with Tun Salleh that an RCI be set up to review the matter once and for all. He is not afraid of finding the truth. Why should we prevent him from doing that? Money, ex-gratia or otherwise, cannot clear his name, only the truth can. Most of us seemed to think that the whole affair was TDM's sole doing. It may be or it may not be. Too many questions left unanswered. Too many personalities were invovled. Too much to pin the blame on one person.

Coming from Mahathir crony you should just ignore him. What matters most is that the Judiciary Commision has already determined you have been victimized, so don't be rattled by the pest, Matthias. The fact is clear. Mahatir screwed up the judiciary. That was bad. About Abbas's right or wrong, it really doesn't matter to me anymore. The process of reforming the judiciary has began and it is hope that the govt can show us her sincerity. Otherwise, malaysians will vote for total change the next round.

Malaysians are also aware that the BN may call for snap poll in the hope that the BN will be return with bigger results and can stop the reform which Malaysians demand.

I shall say fat hope and if you still think that March 8 was a fluke, you are mistaken.

It was no fluke, if BN govt ever call for a snap poll, Pakatan wuill take over.

I prefer you ignore these politicians, especially that Chang that made this comment. He is speaking in behalf of a man whom we know distorted the truth for far too long. Now in the twilight of his age, he still want to instigate racial hatred and umno supremecy. He is gone, Tun.

By the way, to me you deserve your TUN title very well - but that title had been cheapened by the man that caused your earlier downfall. Right now enjoy your recognition TUN.

Tun Salleh, I know your story well. They will NEVER set up a Royal Commission to look at your case. You know why ? They are still alive - the criminals who did what they did to you and the country ! So, it would be naive to expect them to fulfil your and our wishes !

Pardon me. Can you please tell the entire nation - in layman terms, what wrong did you actually commit to deserve the sacking. To sack a man of your standing is not that easy. So the sacking must have been very justified by the then administration. Olih kerana ini cerita yang dah lama banyak orang dah lupa kepala ekor isu sebenar.
