Hindraf Five File For Judicial Review

PUTRAJAYA, May 20 (Bernama) -- Five leaders of the Hindu Rights Action Force (Hindraf) who have been detained under the Internal Security Act Tuesday filed an application for a judicial review of the Federal Court decision which rejected their habeas corpus appeal to be freed. The application was filed at the Federal Court Registrar's Office here by the law firm Karpal Singh & Co.

Filed together with the application was a sworn affidavit by lawyer Karpal Singh, who is acting for the five.

On May 14, a three-judge panel of the Federal Court headed by Chief Judge of Malaya Datul Alauddin Mohd Sheriff unanimously determined that the order for their detention at the ISA camp in Kamunting, Taiping by Prime Minister Datuk Seri Abdullah Ahmad Badawi, who was also the Internal Security Minister then, was lawfully executed.

The five are lawyers M. Manoharan, 46, who is also the state assemblyman for Kota Alam Shah, P. Uthayakumar, 46, V. Ganabatirau, 40, R. Kenghadharan, 40, and former bank officer K. Vasantha Kumar, 36.

They were held under the ISA on Dec 13 after being involved in street demonstrations in Kuala Lumpur on Nov 25 and issuing slanderous statements against the government.

They had brought the case to the Federal Court after failing to get the High Court to release them.

With all the judges in the pocket of UMNO, there is little hope. Every single judge is suspect.

Wait until PR takes over the government. There should be a judicial tribunal to discipline every single one of them, and remove their pensions.

Every single judge found guilty will find his name being cited in future law studies as case examples.

Why are still holding them under ISA? As a PM, you should release them. Atleast you will gain some respect from the malaysian indian.It is not indian are hate you now but the malays are really dont like you. You see what happen now, Tun M and his son quit the party. Sooner later there will be more UMNO members will quit. Your enemy only UMNO malays.

In the first place, the government should not have detained these people. Now that the mistake ia made, it would be very good if AAB can release them on his own accord and bet you, AAB will win a lot of admirations from the raayat for making the bold decision for the nation. We need leaders who are positive, open and courageious, not a timid, slow and irresponsible towards its own people.

I have been saying these over many times, and yet AAB don't seem to know this little wise move to win raayat. God bless those detained in Kamunting.

There is the latest report that a Hindraf detainee in the Kamunting jail was tortured and now confined to wheel chair. Is this a lawless society? There should be another Bersih Walk to bring this matter up to the government who choose not to know. In fact, my contention is that the Bar Council should initiate legal action to bring the prison authority to court.

The point is we are a lawful amd law abiding nation, no amount of injury should be caused to the detainees except subject them to court hearing if they are found guilty. This act of uncivilized people must be put to a stop for the sake of the nation. I am still counting on those who were elected in the recent GE to take positive steps to rectify the serious man-handling of the detainees.
We are talking about human rights - BUT do we have this basic fundamental I wonder?
