STOP TWISTING THE STATEMENT BY KARPAL SINGH

The MP for Klang, Charles Santiago calls on UMNO, Prime Minister Abdullah Ahmad Badawi and the vernacular Malay newspapers to stop twisting the statement by Karpal Singh into a race-related issue.

All Malaysians regardless of ethnicity and faith see the Malay Rulers as the symbol of our nationhood and want our constitutional monarchy to function in a healthy manner.

He strongly condemns the seditious insinuations that non-Malays are disrespectful of the Rulers.

Whether or not anyone agrees with Karpal's perspective, his freedom of expression and the democratic space for debate must be protected.

He reminded BN that Attorney-General Abdul Ghani Patail's statement just two months ago that the King has no power to determine the Mentri Besar of Terengganu was a similar view.

Should the AG - and the PM who held the same perspective - be charged for sedition or accused of treason too?
Charles urges UMNO and the premier to instead look into the merits of Karpal's argument and stop devious attempts to gain political mileage by diverting peoples' attention from pressing issues in the country and the looming crisis within UMNO.

Karpal's statement did not question the prerogative of the Sultan as head of religion in Perak. He commented that Sultan Azlan Shah did not have jurisdiction over the transfer of the state Religious Department Director Datuk Jamry Sury.

Karpal's statement is in line with what is stipulated in the constitution. Although Sultan Azlan Shah is the head of Islam in his state, the power to transfer a civil servant lies with the state secretary, who in turn takes orders from the Mentri Besar of Perak.

Karpal Singh had also cited a decision made by the Federal Court in 1982 in the case of the Federal Territory Education Director and Others vs Loot Ting Yee. Here, the court ordered that "whether a civil servant should be transferred, and if so, where and when the transfer is to be made are matters for the government to decide."

卡巴星的言论与宪法条文一致。即使苏丹阿兹兰莎是州宗教首长,调动公务员的属于州秘书权限,州秘书则需要听令于霹雳州务大臣。

卡巴星也引用了1982年联邦法庭的判决--联邦直辖区教育总监和陆庭谕案件。法庭的议决指出:“一名公务员调动与否,同样的,无论在什么地点和时刻,都是由政府来决定”

Ahli Parlimen Kelang, Charles Santiago meminta agar UMNO, Perdana Menteri dan akhbar-akbar tempatan berbahasa Melayu berhenti membelokkan kenyataan Karpal Singh menjadi isu yang berbau perkauman.

Semua rakyat Malaysia tak kira kaum mahupun kepercayaan melihat Raja-raja Melayu sebagai lambang kedaulatan dan menginginkan raja berperlembagaan kita berfungsi dengan sihat. Beliau dengan kuat mengutuk kata-kata berbau hasutan bahawa orang bukan Melayu tidak hormat kepada Raja-raja. Beliau mengingatkan BN bahawa kenyataan Peguam Negara Abdul Gani Patail hanya dua bulan yang lalu bahawa DYMM Seri Paduka Baginda Yang diPertuan Agong tidak mempunyai kuasa untuk menentukan Menteri Besar Terengganu mirip pandangan Karpal.

Apakah Peguam Negara – dan Perdana Menteri yang memiliki perspektif yang sama – patut disabitkan dengan tuduhan hasutan dan pengkhianatan juga? Charles sebaliknya mendesak agar UMNO dan Perdana Menteri melihat kewajaran hujah Karpal dan segara memberhentikan cubaan untuk mengaut keuntungan politik dengan membelokkan perhatian rakyat daripada isu-isu yang lebih penting serta krisis yang kian membara di dalam UMNO.

Kenyataan Karpal tidak mempersoalkan hak istimewa Sultan sebagai ketua agama di Perak. Beliau hanya mengemukakan hujah bahawa Sultan Azlan Shah tidak mempunyai jurisdiksi atas perpindahan Pengarah Jabatan Agama Negeri Datuk Jamry Sury.

Kenyataan Karpal selari dengan apa yang telah ditetapkan dalam perlembagaan. Walaupun Sultan Azlan Shah adalah Ketua Agama Islam di negeri DYMM, kuasa untuk memindahkan seorang pegawai awam negeri terletak dengan Setiausaha Negeri, yang menurut arahan daripada Menteri Besar Perak.

Karpal Singh juga telah mengemukakan keputusan yang dibuat oleh Mahkamah Persekutuan pada 1982 dalam kes Pengarah Pendidikan Wilayah Persekutuan dan Lain-lain lawan Loot Ting Yee. Di sini, mahkamah tersebut telah memerintah “sama ada seorang pegawai awam harus dipindahkan, dan jika demikian, di mana dan bilakah perpindahan itu akan berlaku adalah perkara yang diputuskan oleh kerajaan pemerintah.

PR please wake up. Just do not make statements. Go make reports against the AG and the PM. Even in the old cases as far back as the times when the UMNO[putras and the press vilified the monarachs.

The AG is a shit head and more shit will be on his face when the RC report is made public. You will see why he tried so hard to cover all the shit in the Lingam tapes!

What does it say when a situation where an MB was willing to admit his impoliteness at the expense of being incorrect and is defended by his peer for his technical correctness is attacked WITH the police is to me symptoms of IGNORANCE, SELF-CENTREDNESS, UNHEALTHY OPPORTUNISM - and ALL THE WAY UP TO THE PM.

Am sure if we allow the Dean from the Oxford University England to interpret, he will come back in favour of Yb Karpal. - 2 sets of law in Malaysia the "serba boleh land". One is UMNO law, the other is constitutional law. When there's any dispute, please refer to UMNO law.

Appointment as Menteri Besar

Following the ruling party UMNO's return to power over Terengganu after winning 24 out of 32 seats in the 2008 general elections, Prime Minister (PM) Abdullah Ahmad Badawi put forth the reappointment of Datuk Seri Idris Jusoh to began the second term as Menteri Besar. In what political analysts describe as a possible constitutional crisis, trouble began to precipitate after the Sultan of Terengganu, Tuanku Mizan Zainal Abidin, who is also current Yang di-Pertuan Agong (King) of Malaysia refused to re-appoint and swear in Idris as Menteri Besar.[1] Similar problems occurred in the state of Perlis where the PM's choice was also rejected, in which the latter eventually gave in to its sultan.[2]

Terengganu's sultan appointed Ahmad Said instead for the job, with the Regency advisory Council handing him the letter of appointment. The PM claimed that the appointment of Ahmad Said was unconstitutional as it went against the wishes of the assemblymen and the Prime Minister's office who have supported Idris Jusoh candidacy for Menteri Besar.[3] In spite of threats to strip Ahmad Said of his party membership "for disobeying the leadership", he went to the office in Wisma Darul Iman to begin the first day of his new appointment on 25 March 2008. The party announced earlier that they made good on their promise to remove his membership, which technically disqualifes him to be appointed as Menteri Besar in the first place.[4] The ruling also planned to vote down the sultan's choice through a motion of no-confidence by 22 UMNO state assemblymen. The opposition party Parti Islam SeMalaysia in the meantime promised that its assemblymen would support Ahmad Said as Menteri Besar.......
